Terms of Sale

The merchant is obliged to provide the following information and information in a clear, understandable and unambiguous manner before selling (i.e. concluding a contract):
• the different stages that follow in the contract conclusion process (sale/purchase)
• Passengers can purchase tickets for a semi-submarine ride at our sales stand located at obala Kralja Petra Krešimir IV. Tickets for departures from their resort are sold at the reception of the PineBeach tourist resort and payments are made through the Pinebeach resort cash desk, and online on our website www.semisubmarine-pakostane.com . Payment at our sales counter in cash. Semi-submarine departures are from the Riva in Pakoštane and from Pinebeach. Plava laguna d.o.o. (hereinafter referred to as the Carrier) reserves the right to board some people on the Riva in Pakoštane in order to optimally fill the vessel and, if there is space, to pick up guests from the Pinebeach resort. Guests will ultimately receive the same service in terms of a sailing route that is driven at a minimum speed for underwater observation. During the voyage, guests are allowed to stay on the deck of the semi-submarine. Parents are responsible for supervising minors during the voyage. Minors cannot board the vessel alone without their parents' accompaniment, this is exceptionally possible if they are older minors and for whom the parents give their consent to drive themselves without their accompaniment and also confirm that they can swim.
Tickets can be purchased for free dates in which there are available seats. The vessel's capacity is 12 people. In the event that the semi-submarine ride service cannot be performed due to force majeure such as adverse weather conditions, temporary health incapacity of the vessel's management personnel, unforeseen vessel malfunction or some other reason beyond our control that prevents the vessel from setting sail, the ticket buyer has the right to a full refund of the amount paid for the tickets or, if they decide, to exchange the tickets for a new ride date.
In the case of purchasing tickets during the time when there is a siren show (01.07.-31.08. departure times 09, 10, 11, 12, 13 and 14 from Monday to Saturday) and the show cannot take place due to adverse weather conditions (these conditions refer to, for example, rain or cold weather, strong wind and similar weather conditions during which it is not advisable to enter the sea, but the vessel can still sail without affecting the safety of navigation), passengers will be informed of this shortly before boarding the vessel or before that if possible. The options that passengers have in these circumstances are that they have the right to cancel the trip and refund the full amount paid, or go on the ride at the price of the regular ride. The carrier will refund the excess amount of the ticket compared to the regular ride. Transactions of this type are carried out exclusively at the sales counter on the Riva, and for guests from the Pinebeach resort at the Pinebeach resort reception. Any changes to dates, refunds, etc. it can be done at our sales desk, and by contacting us by e-mail: info@semisubmarine-pakostane.com.
Customers have the right to cancel the ride up to 1 hour before departure and the right to a full refund of the amount for paid tickets as described above.

Services ride that you buy at our sales counter or website

• contractual provisions: The carrier is obliged to compensate for property and non-property damage that occurs during the ride, damage to health, injury or death of the passenger, unless it was caused by the passenger's actions or by an external cause that could not have been foreseen, avoided or eliminated. If the damage was not caused intentionally or by gross negligence, the carrier is obliged to compensate for the damage up to the amount stipulated by the positive regulations of the Republic of Croatia or an international agreement. The carrier may be released from liability for damage if it proves that the damage was caused by the passenger's actions or force majeure. The carrier is not liable for damage that is not causally related to the transportation performed.

General terms and conditions if they are an integral part of the contract The General Terms and Conditions apply to business based on Regulation (EU) No. 1177/2010 of the European Parliament and of the Council of 24 November 2010 concerning the rights of passengers when travelling by sea or inland waterway, Regulation (EC) No 392/2009 of the European Parliament and of the Council of 23 April 2009 on the liability of carriers of passengers by sea in the event of accidents, Act on Transport in Regular and Occasional Coastal Maritime Transport (Official Gazette Nos. 33/06, 38/09, 87/09, 18/11, 80/13, 56/16, 121/19).

If the buyer does not board the vessel at the time for which he purchased the tickets, he is not entitled to a refund unless he has notified the carrier in any way at least 15 minutes before the start of the voyage about the impossibility of arriving for boarding. On the other hand, if there are justified reasons why the passenger was unable to notify the carrier of the inability to arrive for boarding, the carrier will in good faith allow the passenger to use the unused tickets for another date that is free and suitable for the passenger.

The trader is obliged to provide the potential buyer with technical means for recognizing and correcting incorrect data entry before completing the purchase.

Contractual provisions and provisions of the general terms and conditions of contracts concluded in electronic form must be available to buyers in a way that allows them to save, reuse and reproduce them.
